Website Use
The customer is authorized to use the website and all its subdomains solely for the purpose of making legitimate inquiries or reservations, and agrees not to make speculative, false, or fraudulent reservations, nor reservations made in anticipation of demand. Likewise, the customer agrees to provide Cerro Castor S.A. – Beaver Mountain S.A. and Punto Austral (Duna S.A.) with correct and accurate contact information, such as an email address, and consents, if necessary, to its use as a means of contact.
Acceptance of the Conditions
By visiting and using the website and all its subdomains, the consumer/client expressly accepts each and every one of the general conditions, which are deemed to be automatically incorporated into the contract, without the need for individual written transcription, and which supplement and develop the applicable specific legislation without contravening it.
Use of the Customer’s contact Information
The customers, as the holders of the reservation, guarantee that they are over 18 years of age and legally qualified to use the website and all its subdomains and to enter into legal obligations.
The customer guarantees that the personal data provided during the reservation process is accurate and accepts financial responsibility for any transaction made under their name or account.
In accordance with this document, the customer authorizes Cerro Castor – Beaver Mountain and Duna to include all personal data provided in connection with a booking—both their own and that of all persons included in the reservation—in a confidential database for future communications, as established under Law No. 25,326 of October 20, 2000, regarding the protection of personal data. To access, correct, delete, or object to the processing of such data, the reservation holder must submit a request to: contacto@cerrocastor.com
Passenger Data
The customer guarantees that the personal data provided during the reservation process, both their own and that of all persons included in the reservation, is accurate.
Ski Resort Services
Cerro Castor acts both as the owner and as the provider of the resort services offered on its domain and which are available for sale on this website.
Cerro Castor’s own services include: lift passes and Castor Ski Lodge accommodation.
Beaver Mountain services include: ski lessons, equipment rental, and food and beverage services. Punto Austral Turismo, file Number 14097 (Duna S.A.), acts as an intermediary travel agency between the various service providers and the customer.
LIFT PASSES1. The pass is non-transferable and non-refundable.
2. Passes for more than one day must be used on consecutive days. Any unused day is lost.
3. The company is not responsible in case of theft, loss, or total or partial destruction of the pass. The user must pay the reprint or obtain a new one to continue using the slopes. The same process applies when forgetting the pass.
4. The skier assumes all risks and responsibilities for damages to themselves and/or others caused as a consequence of the inherent risk of the winter sport practiced and/or their negligent or reckless actions when using the facilities.
5. The pass may be used exclusively for recreational and/or sporting purposes. Commercial and/or profit-making use is strictly prohibited.
6. The full or partial closure of lifts due to adverse weather conditions, and/or for safety or operational reasons, and/or for any other reason, does not entitle the holder to claims, refunds, or pass exchanges. Likewise, unused pass days are non-refundable.
7.Cerro Castor will not honour date changes or refunds for confirmed reservations outside the terms established in this document, including those due to issues or changes made by airlines.
8. Delivering the pass to third parties for use, or tampering and/or falsification of it, constitutes the crime outlined and penalized by Articles 172 and 174 of the National Penal Code in Argentina. In such cases, the pass will be immediately invalidated.
9.The ski pass and a valid proof of identity must be shown by the user whenever requested by company staff.
10.
The pass may be immediately revoked in case of user misconduct and/or damages caused to others.
11. Skiing, snowboarding, or any other activity outside authorized slopes is done under the user’s total responsibility.
12. Purchase of the pass implies basic nursing service for accidents occurring exclusively on authorized slopes. If the injury requires it, the user will be provided ambulance transfer without a doctor to medical centres in the City of Ushuaia.
13. Users on unauthorized slopes will have their pass immediately cancelled.
14.Partial or total slope closures, for any reason, do not entitle the user to claims.
15. Season start and end dates may change without prior notice and do not entitle users to claims.
16. All rates are subject to change without prior notice.
17. Types of Passes:
Pedestrian Pass: Allows access for individuals without ski or snowboard equipment. It allows a single ascent and descent to Cota 480 via the “del Bosque” Chairlift. It can only be purchased at the resort ticket office on the same day of use.
Skier Pass: Allows access for skiers to all enabled lift facilities.
18. Pass Categories
Infant:0 to 4 years old inclusive. (Requested at the ticket office upon presentation of an ID document)
Child: 5 to 11 years old inclusive.
Adults: 12 to 69 years old inclusive.
Senior: 70 years old and over. (Requested at the ticket office upon presentation of an ID document)
19.There are ski runs exclusively designated for competition team training; therefore, public access to these runs may be partially or totally restricted.
20. The purchase implies acceptance of and compliance with waiting times and the exclusive and/or priority use of turnstiles. Cerro Castor staff may require that lift facilities operate with all seats fully occupied.
EQUIPMENT RENTAL:The rental of equipment implies that the user acknowledges and accepts each and every one of the following general terms and conditions of sale:
1.The customer is fully responsible for the theft or loss of the rented equipment or any part thereof and, in such cases, must pay the full replacement value of the equipment.
2. In the event of any total or partial damage to the rented equipment or any of its parts, the customer shall pay the replacement value.
3. Any amounts paid by the customer for equipment rental shall not be refunded or reimbursed under any circumstances. Likewise, the transfer of rented equipment to any person other than the registered customer is expressly prohibited.
4. All rented equipment must be returned by the customer to company staff every day before the closing of Cerro Castor – Ushuaia resort. If the customer wishes to keep the equipment for the duration of the rental period, this must be reported at the rental office so that the corresponding procedure and requirements can be provided.
5. The customer must ensure that they verify and identify the equipment rented in order to avoid loss and/or confusion regarding which equipment corresponds to them. Returns of equipment that do not match the one originally rented by the customer will not be accepted.
6.Equipment rental to minors is not allowed unless they are accompanied by their parents or legal guardians.
7. If the equipment is rented for use by a minor, the parents or legal guardians assume full responsibility for the equipment or any part of it and shall be liable for theft, loss, damage, or total or partial breakage.
8. The company is not responsible for the theft or loss of personal belongings.
9. The company is not responsible for accidents and/or injuries suffered by the customer or third parties during the use of rented equipment.
10. The total or partial closure of lift facilities due to adverse weather conditions and/or safety and/or operational reasons and/or other causes does not entitle the customer to claims, refunds, or exchanges of the rented equipment. The same applies to unused equipment.
11.Beaver Mountain will not grant date changes or refunds for confirmed reservations outside the terms established in this document, including those resulting from issues or changes made by airline companies.
CASTOR SKI LODGEPunto Austral (Duna S.A.) acts solely as an intermediary for accommodation and other services, as well as a booking agent on behalf of the user. Accordingly, it shall not be held liable for any death, injury, illness, damage, loss, accident, theft, delay, or any other irregularity arising directly or indirectly from the provision of services by the hotel or by other providers that market their accommodation, services, and products through the website. Punto Austral (Duna S.A.) is exempt from any contractual, non-contractual, or other form of liability. Accommodation and service providers are the suppliers or owners listed on the website and its subdomains, and shall include all facilities and services offered through the website and its subdomains.
·· Star Rating and Accommodation QualityStar ratings correspond to the destination’s own classification system and conform to local regulations. They are provided for general descriptive purposes only and may not apply in all cases. The type of rooms offered by a hotel (e.g., single, double, etc.) may vary. It is the customer’s responsibility to verify the type of accommodation and the services provided by each hotel. The customer acknowledges that no quality control inspections have been carried out on the establishments offered on the website and its subdomains, and that we are not responsible for the suitability of the accommodation or the services provided. The inclusion of accommodations on the website does not imply any recommendation or endorsement by Punto Austral. We disclaim any liability for inaccuracies related to accommodations and services offered on the website and its subdomains.
· · Rates, Reservations, and PaymentsThe rates indicated are in U.S. dollars and expressed in Argentine pesos at the exchange rate applicable on the day. In accordance with contractual conditions, the payment terms established must be complied with at the time of booking confirmation. Rates and/or outstanding balances are updated at the exchange rate in effect on the day of payment. The reservation will not be considered confirmed until 100% of the payment has been made. Otherwise, the reservation will be cancelled and the conditions set in the cancellation section will apply. Payments may be made by bank transfer and/or through the electronic payment methods enabled on the website.
The reservation includes the services specified in the booking confirmation. Please carefully read all accommodation information (if provided), as additional supplements and extra services may apply and must be paid directly at the property. Cerro Castor – Beaver Mountain and Duna S.A. are exempt from any contractual, non-contractual, or other liability in relation to such services and supplements.
· Pending Reservation RequestsPrices and availability of requested services are provided for informational purposes only and are subject to availability verification at the time the reservation is confirmed by Castor Ski Lodge.
· ConfirmationOnce the customer has made full payment of the reservation as indicated above, they will automatically receive a voucher. This voucher constitutes the basis of the booking contract. The customer acknowledges that it is their responsibility to verify the confirmation and ensure that all details are correct, as services can only be provided in accordance with the details specified in the reservation.
· Handwritten SignatureDue to the special nature of distance contracting, the customer acknowledges the impossibility of signing the payment authorization document, which is the document usually used to formalize acceptance of the transaction. Therefore, the customer waives the requirement of a handwritten signature for the entire electronic transaction generated as a result of the reservation made through the website and all its subdomains. The person completing the booking form on the website must be authorized to do so on behalf of all members of the travel group and must confirm that all the members accept the booking conditions. This person shall also be responsible for the total cost of the reservation, including any cancellation or modification fees. Likewise, this person shall inform the group members of the confirmation details and any other relevant information.
· Delivery of DocumentationIn order to facilitate and streamline access to services, Cerro Castor – Beaver Mountain and Duna S.A. provide customers with the digital and automatic delivery of the confirmation, voucher, and invoice for services that have been contracted and fully paid.
The costumer must present the voucher issued by the reservation centre, either in physical or digital format, in order to receive the services.
·Cancellation and Modification ConditionsThe customer may cancel the reservation without penalty up to 10 days after the purchase date. After this 10-day period, the following conditions apply:
Modifications:
- Up to 30 days prior to Check-In, modifications may be made without penalty, subject to availability.Reservations that shorten their stay once Check-In has taken place will not be eligible for refunds or credits for future reservations.
Cancellations:
- Up to 30 days prior to Check-In, no cancellation fees will apply. The amount paid will remain as credit for future reservations, subject to availability. This credit will be valid for 1 year from the cancellation date.
- Between 25 and 15 days prior to Check-In, 50% of the total reservation amount will be retained as a cancellation penalty. The remaining balance will remain as credit for future reservations, subject to availability. This credit will be valid for 1 year from the cancellation date.
- Within 15 days prior to Check-In, 100% of the total reservation amount will be retained as a cancellation penalty and will not be recognized as credit toward future stays.
· Refunds:
- Castor Ski Lodge will not issue refunds for cancelled or modified reservations.
If the customer cancels the reservation, additional charges may be incurred by accommodation providers and additional service suppliers. Each service provider and promotion has its own cancellation and/or modification policy, which is detailed in the service description at the time of purchase.
GUARANTEEProhibition on departure imposed by the country of origin through an official communication issued by an accredited public institution or governmental authority.
Prohibition on entry into the country or into the Province of Tierra del Fuego, officially decreed by the Government of Argentina or other local authorities.
In the case of accommodations, the modification or cancellation policies of each hotel shall apply.Flight restrictions or complete closure of airports in Argentina.
FORCE MAJEURECerro Castor – Beaver Mountain and Duna S.A. shall not be held liable for any change, cancellation or modification of a reservation, nor for any loss or damage caused by the failure of the parties responsible for providing the services to comply with their respective obligations to the customer, when such failure is due to force majeure circumstances. Such circumstances include, by way of example and without limitation: wars, revolutions, terrorist attacks, border closures, natural disasters, or any other circumstance that may seriously affect either party, as well as any other unforeseeable event beyond the control of Cerro Castor – Beaver Mountain and Duna S.A.
ACCURACY OF INFORMATIONThe customer acknowledges and agrees that Cerro Castor – Beaver Mountain and Duna S.A. shall not be held liable for any inaccuracies in the information provided by third-party service providers. The customer further acknowledges that such service providers make reasonable efforts to ensure that the information published on this website is accurate and up to date. Accordingly, the customer understands and accepts that all information and prices displayed on this website are subject to change without prior notice and are provided for informational purposes only.
GOVERNING LAW AND JURISDICTIONThe application and interpretation of these general conditions shall be governed by the laws of the Republic of Argentina. Any dispute arising from the interpretation or performance of any of these conditions shall be subject to the exclusive jurisdiction of the courts of the City of Ushuaia, Province of Tierra del Fuego, Antarctica and South Atlantic Islands, Republic of Argentina, with the parties expressly waiving any other jurisdiction that may apply.
